California employers are prohibited from discriminating against employees on the basis of age (40 and over), race, religion, color, national origin, genetic information, marital status, gender, gender identity, gender expression, sexual orientation, and military and veteran status. The law prohibits discrimination with regard to these protected characteristics when it comes to hiring, firing, promotions, job assignments, and various other terms and conditions of employment.
Employment discrimination claims fall into two general categories: disparate treatment and disparate impact. Disparate treatment occurs when an employee is singled out and treated differently by an employer because of his or her protected characteristic. Disparate impact occurs when a seemingly innocent employment practice or policy adversely affects the members of a protected group. Depending on whether a discrimination claim is based on a disparate impact or disparate treatment theory, there are different elements that must be established in order to prove a claim.
